Eligibility

To use our services, you must:

• Be legally capable of entering into a binding contract under applicable law.

• Provide accurate and complete information.

• Use the platform only for lawful purposes.

Businesses using our corporate services confirm that the person placing orders or signing agreements is authorized to act on behalf of the organization.

User Account

You may be required to create an account to access certain services.

You agree to:

• Maintain accurate account information.

• Notify us immediately of any unauthorized access.

• Accept responsibility for activities carried out through your account.

CityMali reserves the right to suspend or terminate accounts that violate these Terms.

Products and Services

We strive to ensure that product descriptions, images, prices, and specifications are accurate. However:

• Actual plant size, colour, shape, and appearance may vary due to natural growth.

• Decorative accessories shown in images may not be included unless specified.

• Availability is subject to stock.

• Service coverage may vary by location.

Pricing

All prices displayed are in Indian Rupees (INR), unless otherwise stated.

Prices may change without prior notice.

Taxes, delivery charges, installation charges, and service fees may apply separately where applicable.

Orders

CityMali reserves the right to:

• Accept or reject any order.

• Cancel orders due to pricing errors, stock issues, suspected fraud, or unforeseen circumstances.

• Limit purchase quantities where necessary.

An order confirmation does not guarantee acceptance until the order is processed.

Payments

Payments may be made through approved payment methods available on the platform.

We do not store your debit card, credit card, UPI PIN, or banking credentials.

Payment failures caused by banking systems or third-party providers are outside CityMali's control.

Delivery

Delivery timelines are estimates only.

Delays may occur due to:

• Transportation disruptions

• Natural disasters

• Incorrect customer information

Risk in products generally passes to the customer upon successful delivery, unless otherwise agreed.

Installation Services

Customers shall provide:

Additional work beyond the agreed scope may incur extra charges.

Corporate Plant Rental

For plant rental services:

• Plants remain the property of CityMali unless otherwise agreed.

• Customers shall provide reasonable access for scheduled maintenance.

• Customers are responsible for preventing intentional damage or theft while the plants are on-site.

• Replacement charges may apply for damage caused by negligence, vandalism, or misuse.

Annual Maintenance Contracts (AMC)

AMC services are governed by the signed quotation or agreement.

Unless otherwise stated:

• Service frequency follows the agreed schedule.

• Delays caused by restricted site access may require rescheduling.

• Consumables, replacements, and additional work outside the agreed scope may be billed separately.

Marketplace Sellers

Where products are supplied by third-party sellers:

• Sellers are responsible for product information and fulfilment obligations assigned to them.

• CityMali may facilitate transactions but does not guarantee every third-party listing.

• CityMali reserves the right to suspend or remove sellers who violate platform standards.

Customer Responsibilities

Users agree not to:

• Provide false information.

• Misuse the platform.

• Attempt unauthorized access to systems.

• Introduce malicious software or code.

• Interfere with platform functionality.

• Use the services for unlawful purposes.

• Copy or exploit content without permission.

Returns, Refunds and Replacements

Return and refund eligibility depends on the nature of the product or service and the applicable Return & Refund Policy.

Live plants are perishable products. Due to their nature, returns or replacements may be limited unless the product is received damaged, defective, or incorrect, subject to verification.

Cancellation

Orders may be cancelled before dispatch, subject to our cancellation policy.

Customized products, landscaping projects, and scheduled services may not be eligible for cancellation once work has commenced.

Cancellation charges may apply where costs have already been incurred.

Intellectual Property

All content on the CityMali platform, including but not limited to:

• Logos

• Branding

• Product Images

• Graphics

• Videos

• Articles

• Blogs

• Designs

• Layouts

• Software

• Text

• Trademarks

is owned by or licensed to CityMali and is protected under applicable intellectual property laws.

No content may be copied, reproduced, modified, distributed, or used without prior written permission.

User Content

By submitting reviews, comments, photos, or other content, you grant CityMali a non-exclusive, royalty-free, worldwide license to use, reproduce, display, and publish such content for business and promotional purposes, subject to applicable law.

You remain responsible for ensuring that your content does not infringe the rights of others.

Third-Party Services

CityMali may integrate with third-party services such as payment gateways, logistics providers, mapping services, or analytics tools.

Your use of such services may also be governed by the respective third-party terms and policies.

Limitation of Liability

Suspension and Termination

CityMali may suspend or terminate access to the platform without prior notice if:

• These Terms are violated.

• Fraudulent activity is suspected.

• Legal compliance requires such action.

• Platform security is at risk.

Termination does not affect rights or obligations accrued before termination.

Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of India.

Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Pune, Maharashtra, unless otherwise required by applicable law.
